Scott was born and raised in eastern Montana. He graduated with honors from the University of Montana Law School in 2011, where he served as the Articles Editor for the Montana Law Review. Scott also interned for a federal magistrate judge, the Honorable Jeremiah Lynch in Missoula. He competed on UM Law’s National Moot Court Team, and his team won both first place brief and first place overall for the Northwest Region. After law school, Scott served as a law clerk for the Honorable Brian Morris, a Justice at the Montana Supreme Court.
Since joining private practice, Scott has been involved in various forms of litigation including class actions, construction law, insurance coverage disputes and regulation, employment law, civil rights and discrimination claims, and personal injury cases.
In 2017, Scott obtained a nearly $400,000 judgment from the Montana Human Rights Bureau against an employer retaliating against an employee for pursuing a discrimination claim. This judgment is one of the largest (if not the largest) awards ever received from the Bureau, and it made Scott a nominee for Montana Trial Lawyer of the Year. He continues to practice regularly before the Montana Human Rights Bureau on various discrimination cases. Scott has also been invited by the Trial Lawyers Associated to present on Human Rights.
Another primary area of Scott’s practice concerns representing homeowners in construction law claims. This work includes construction defects, construction liens, and Consumer Protection cases stemming from dubious practices in the construction industry. In November 2019, Scott obtained a $575,000 settlement for his clients stemming from various defects on a million dollar home, and that settlement also included the contractor forgiving an approximately $250,000 construction lien.
Scott also routinely represents individuals in personal injury claims. This includes car accidents, medical malpractice claims, products liability claims, and workplace injuries to name a few.
Currently, Scott is working on a national class action against an insurer for systematically underpaying benefits. The firm was successful in having the class certified, and the court appointed John Morrison and Scott as class counsel. They have been successful in obtaining summary judgment for the class, meaning that the Court has ruled the insurer breached its agreement with its insureds.
